Terms of Service

Welcome to Kulture+. These Terms of Service ("Terms") govern your use of the Kulture+ website, mobile applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

Throughout these Terms, we use certain defined terms:

• "Kulture+", "we", "us", and "our" refer to Kulture+ GmbH, the company that operates the Service.
• "User", "you", and "your" refer to any individual or entity that uses the Service.
• "Organizer" refers to a User who creates and manages events on the Service.
• "Attendee" refers to a User who registers for or attends events listed on the Service.
• "Content" refers to text, images, photos, audio, video, and all other forms of data or communication posted on or transmitted through the Service.

To access certain features of the Service, you must register for an account. When you register, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you are at least 18 years old. If you are under 18, you may only use the Service with the involvement and consent of a parent or guardian.

You agree not to use the Service to:

• Violate any applicable law, regulation, or these Terms.
• Post or transmit Content that infringes upon the rights of others, including intellectual property rights.
• Post or transmit Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Collect or store personal data about other users without their consent.
• Engage in any activity that could damage, disable, overburden, or impair the Service.

All payments made through the Service are processed by our third-party payment processors. By making a purchase, you agree to provide accurate payment information and authorize us to charge your payment method for the total amount of your purchase.

Refund policies are set by Organizers and may vary by event. Kulture+ is not responsible for processing or issuing refunds for tickets, except as required by law. All refund requests must be directed to the Organizer of the event.

The Service and its original content, features, and functionality are owned by Kulture+ and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

By posting Content on the Service, you grant Kulture+ a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such Content in connection with providing and promoting the Service.

To the maximum extent permitted by law, Kulture+ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service.
• Any conduct or Content of any third party on the Service.
• Any Content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or Content.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Kulture+ expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Kulture+ makes no warranty that the Service will meet your requirements, be available on an uninterrupted, secure, or error-free basis, or that defects will be corrected, but we'll try our best :)

You agree to defend, indemnify, and hold harmless Kulture+ and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney fees and costs, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
